When we talk about the concept of the death penalty, it takes the definite article, 'the'.  So, in this question you should write:

"Do you think the death penalty is right?"

When we use the term 'capital punishment', however, we do not use the definite article.

"Do you think capital punishment is right?"

I hope this helps.

Great answer Kimberly.

I couldn't help but smile as I wondered if the question was a play on the appropriateness of a sentence ;)

I believe the question wasn't about whether or not it is written grammartically correct. I guess ghabby wanted to know your opinion on the question. Anyways, here is mine: "I against it simply because it doesn't stop criminals from killing. We just increase the number of people killed."
